Hybrid Vapes | Will 2+10ml systems soon be banned?

In October 2024, the new Tobacco Products Act was enacted in Switzerland. This law limits liquid pods to a maximum of 2 ml. For hybrid products, this pod can be supplemented with a 10-ml refill container. The Federal Supreme Court has now ruled that, contrary to expectations, at least two products of this type are not permitted.

What are the implications of the Federal Supreme Court's ruling?

Even though the Federal Supreme Court’s ruling applies only to the Lost Mary (old version, now virtually unavailable in Switzerland) and Elfbar (now virtually unavailable), the decision is likely to set a precedent for all 2+10ml hybrid products. It is expected that no new products of this type will be allowed to be imported into Switzerland.

Will Big Puff Vapes no longer be available in the future?

We expect that new products will soon be introduced to the market that comply with the law but still offer a high number of puffs. Products such as the Vaal E-Pack or the Sikary S10000 show the direction in which development might be heading.

Our conclusion

To date, we have not found any clear justification for the ban on vape pods containing more than 2 ml of e-liquid. It is therefore hardly surprising that manufacturers are looking for ways to continue offering customers a long vaping experience with many puffs without the hassle of refilling. If lawmakers continue to heavily regulate products with a high number of puffs, the market will shift toward 2ml pods and open pod systems. These offer the same vaping experience but are more cumbersome to use, as pods often need to be changed or the e-liquid refilled manually.
